1. Acceptance of Terms & Digital Signature

By submitting an enrollment form, completing a purchase, or providing payment information, the student and—if the student is under 18—the parent/guardian (collectively, "The Family") agree to be legally bound by these Terms of Service, the Alta Independent Privacy Policy, the Alta Independent Refund Policy, and the Alta Independent Student Handbook. Submission of enrollment, completion of payment, or provision of billing information constitutes:

  • A digital signature
  • Legal acceptance of these Terms, the Privacy Policy, and the Refund Policy
  • Authorization for recurring monthly billing where applicable

Specifically, checking the required acceptance box at checkout and submitting payment information constitutes a binding digital signature and acceptance of these Terms, the Privacy Policy, and the Refund Policy.

Enrollment requires affirmative acceptance. Continued enrollment constitutes ongoing acceptance of these Terms and any future modifications.

2. The Student Handbook

The Alta Independent Student Handbook is incorporated into these Terms by reference. The Family agrees to comply with all policies including but not limited to: academic integrity and AI policies, attendance, code of conduct, grading requirements, and technology use. Where AI use is permitted, such permission must be expressly outlined in the Student Handbook or provided in writing by the course instructor.

3. Accreditation & Transferability

Alta Independent is accredited through Cognia. Accreditation signifies that Alta meets established standards of educational quality. However, accreditation does not guarantee:

  • Acceptance of credits by any school district, college, university, or athletic association.
  • Automatic transfer of coursework or NCAA eligibility. Transfer credit acceptance remains solely at the discretion of the receiving institution.

4. Utah Academic Standards & Out-of-State Requirements

Alta's coursework and diploma issuance are governed by the academic standards of the State of Utah. Families are responsible for verifying whether Alta's Utah-based coursework satisfies the requirements of another state or jurisdiction. Alta does not guarantee compliance with out-of-state graduation frameworks.

5. Enrollment, Billing & Pricing

  • Automatic Billing Authorization: For monthly plans, The Family authorizes Alta to charge monthly tuition and fees on a recurring basis until termination.
  • Termination Notice: To stop future billing on monthly plans, The Family must provide 30 days' prior written notice to enrollment@altaindependent.com. Specific cancellation notice procedures and their effective date are set forth in the Alta Independent Refund Policy.
  • No Proration: Monthly tuition is charged for the full monthly cycle. No refunds or proration are provided for partial months for any reason.
  • Non-Payment: Failure to pay may result in immediate suspension of services and restricted portal access.
  • Billing Disputes: Families agree to contact Alta to resolve billing concerns prior to initiating a chargeback with their financial institution.
  • Refunds: Refund eligibility is governed by the Alta Independent Refund Policy.

6. Financial Standing & Records Release

Alta reserves the right to suspend access to coursework and withhold transcripts, report cards, and diplomas until all financial obligations are satisfied in full.

7. Educational Services & No Guarantee of Outcomes

Alta provides diploma pathways, credit capture, and partnership programs but does not guarantee graduation timelines, college admissions, employment outcomes, or athletic eligibility.

8. Third-Party Curriculum & Technical Limitations

Alta utilizes third-party providers and is not responsible for technical outages, platform failures, or content modifications made by those providers.

9. Partner & Affiliated Programs

In partnership arrangements, Alta is not responsible for independent academic, clinical, or operational decisions made by partner programs.

10. Credit Capture

Credit Capture is an approved academic process, not a pay-and-receive-credit transaction. Detailed Credit Capture terms, refund conditions, and the money-back guarantee are set forth in the Alta Independent Refund Policy.

11. NCAA Disclaimer

Alta Independent is NOT an NCAA-approved institution. Students seeking athletic eligibility enroll at their own risk. Alta is not liable for NCAA determinations regarding athletic eligibility or scholarships.

12. Academic Integrity & Artificial Intelligence

Unauthorized use of generative AI tools to complete assignments is prohibited. Violations may result in course failure, suspension, or dismissal without refund.

13. Hardware Accommodation (Chromebooks)

Alta may provide a Chromebook as a free service with select plans. Ownership remains with Alta. The device must be returned within 30 days of withdrawal. If not returned, a replacement and recovery fee — usually around $50.00 but not to exceed $200.00 — will be charged to the payment method on file. 14. Technology & Internet Responsibility

Families are responsible for internet security and content filtering. Alta does not guarantee filtering effectiveness or continuous device functionality.

15. FERPA & Privacy

Alta complies with FERPA and applicable state privacy laws. Detailed data practices are described in the Alta Independent Privacy Policy. Families consent to the use of secure third-party platforms necessary for service delivery.

16. Communication Consent

By enrolling, The Family consents to receiving operational communications from Alta by email and text message/SMS for billing notices, academic updates, attendance and progress reports, technical support, and other school-related and operational matters. Marketing communications are separate from operational communications; Families may opt out of non-essential marketing at any time. Standard message and data rates from your carrier may apply to SMS messages. Families may opt out of SMS messaging at any time by replying STOP; opting out of SMS does not opt a Family out of email-based operational notices required for service delivery.

17. LIMITATION OF LIABILITY

ALTA'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT OF TUITION PAID DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM. ALTA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

18. Indemnification

The Family agrees to indemnify and hold harmless Alta from claims arising from student misconduct, academic dishonesty, or violation of these Terms.

19. Force Majeure

Alta is not liable for failures due to causes beyond reasonable control, including natural disasters, internet disruptions, or public health emergencies.

20. Dispute Resolution, Venue & Governing Law

The parties agree to attempt good-faith mediation prior to litigation. Unresolved disputes shall be brought exclusively in the courts of Utah, under Utah law.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

22. Order of Precedence for Partner & Institutional Enrollments

Where a student is enrolled under a separately executed partner, institutional, RTC, or school district agreement, and a specific provision of that agreement conflicts with a provision of these Terms, the separately executed agreement controls for that enrollment only. All other provisions of these Terms remain in full force and effect.

23. Modifications

Alta reserves the right to modify these Terms. Material changes will be communicated via email and apply prospectively; they do not retroactively alter obligations already incurred under a specific transaction unless required by law. Continued enrollment after material changes take effect constitutes acceptance of the updated Terms.
